eSentry's DE4 Annual Contract Works and DE4 Single Project Contract Works insurance policies can now be easily extended to include the new Section 3 coverage for Professional Indemnity. All three Sections (Material Damage, Legal Liability and Professional Indemnity) are issued under a single aligned policy. This means;

  • Coverage does not have the gaps common where separate policies are issued (and sometimes by different Insurers).
  • Your job is easier as you can still get a quote and bind cover by our simple on-line application process.
  • Our competitively priced combined policies now provide brokers with a seamless solution for your SME construction clients, making eSentry the market leader.

eSentry recognised that a typical builders activities may include some level of Professional Service for Project or Construction management. Unlike other insurers that only recognise 'Professional Service" when there is fee activities', as long as these activities are duly noted within the project's construction contract then we will deem these as Professional activities under our Professional Indemnity Basis of Coverage Definition.

Our standard parameters are:

  • Standard building works including residential, commercial, industrial and institutional projects, office / retail fit-out and refurbishment
  • Individual contract values up to $20 million and customers with annual building works with any turnover value, Residential Owner Builders up to $2 million
  • Construction periods up to 24 months

Those risks that fall outside these system guidelines will be referred to eSentry.

Professional Indemnity Basis of Coverage Definition

Professional Services shall mean one or more of the following services conducted by or on behalf of the Named Insured:

(a) design, including advice in relation to design, in accordance with all relevant building, construction or engineering codes and standards;

(b) drafting;

(c) technical calculation;

(d) technical specification;

(e) construction and project management;

(f) programming and time flow management;

(g) quantity surveying; and/or

(h) land and engineering surveying; provided always that it is performed by or under the direct supervision of:

(i) a properly registered engineer, architect or surveyor;

(ii) a quantity surveyor who is a member of the Australian Institute of Quantity Surveyors; or

(iii) any other person providing a professional service of a skillful character according to an established discipline, appropriate to the professional services being performed or supervised.

Professional Services does not mean performance or supervision (where such supervision would normally be undertaken by a building contractor) of construction-related activities, either on-site or off-site, including temporary works, manufacture, assembly, installation, erection, maintenance or physical alteration of buildings, goods, products or property, programming, time flow management, environmental protection, workplace health and safety or industrial relations, by the Insured or its agent, where such performance or supervision is undertaken in the capacity solely as a building or engineering contractor.

For the purpose of this definition, construction and project management means the control, planning, administration, scheduling, evaluation and supervision of construction and completion of a project including the procurement and allocation of labour, materials and services where;

• the Named Insured is specifically remunerated by way of a fee for such service; or

• the Named Insured has not been specifically remunerated by way of a fee for such service, but;

(a) the Named Insured is the head contractor or the main contractor for that project;

(b) the contract the Named Insured has entered into for the purpose of the project contains provisions imposing on the Named Insured the responsibility for construction and project management; and

(c) there is no other construction and project manager or entity responsible for construction and project management for that project.

How it Works

eSentry launched a Pay As You Go Low Deposit Annual policy in 2013. The Pay As You Go Low Deposit Annual (PAYG) policy operates like our standard Annual policy, providing the same coverage and benefits, but has a fixed automatic (floating) Any One Contract limit of $100,000 for Material Damage. On commencement of the policy we collect a deposit premium based on a minimum turnover of $200,000. Like our standard Annual policy, a renewal adjustment at the policy expiry date will need to be completed. We will ask for the value of works completed during the policy period and value of works to finish off and calculate the adjustment accordingly. Should the builder undertake a higher turnover, then the policy will be adjusted and there may be an extra premium to pay. Projects over $100,000 must be added to the policy as a Specified Project, prior to commencement of the project via our simple to use online system. Premium will be charged based on a project value just as a Single Contract Works policy would, the Added Specified Project will benefit from Annual policy & benefits. Cover for Existing Structure can also be easily added for a Specified Project prior to commencement via our online system. Premium will be charged based on the sum insured for the Existing Structure and cover will apply for the duration of the project. PAYG best suits those builders who specialise in projects with a value of $100,000 or less, yet provides the ability to easily add larger projects on demand.

How do I register for broker access to eSentry Online?

Click this link or the Register button above. We will register you and confirm your login details via email in a matter of minutes. (We send a verification email from admin@esentry.com.au to your registered email address, so please check your junk inbox if not received immediatly) If we do not already have your brokerage listed within our system we will arrange for you to be added.

Broker Commission Payable

eSentry provides complete flexibility for all brokers allowing them to choose how they wish to be paid, note that our standard commission rate is set at 20% as a default and is clearly displayed on all documentation.

Terms of Trade

eSentry provides 45 days credit to all registered brokers. Our terms of credit are effective from the policy inception date.

Claims Procedures

eSentry and Tokio Marine are committed to prompt, professional and fair claims handling tailored to the individual needs of our clients. We want to consistently execute best claims practices to achieve the best outcome for our clients.

Making a claim with eSentry is simple and easy. We will help you and guide you through the whole claim process.

  • We will monitor all claims on a regular basis to ensure expeditious settlement.
  • You can choose to deal directly with eSentry or Tokio Marine.
  • All claims must be notified to eSentry or Tokio Marine immediately by downloading and completing the relevant claim form.
  • Please ensure that all relevant details are filled out on the specific Contract Works-Material Damage/ Loss or Contract Works-Liability claim form.
  • It is mandatory to include the subject project details: start and finish dates as well as the contract price.

With each claim form, you will need to attach or forward where applicable:

  • Photographs of the damage.
  • Repair / replacement quotations or order forms.
  • If the damage/loss has been repaired/ replaced please provide invoices.
  • Original purchase receipts/ documentation to show proof of ownership where possible.
  • Scope of repair works.

Once the above is received, Tokio Marine will determine and notify if they require a loss adjustor to attend and inspect damage/ the site. Please retain all damaged items if practical.

Complete Contract Works-Liability claim form.

  • Forward any third party correspondence including letters from solicitors, statements of claim, letters of demand immediately to eSentry/ Tokio Marine.
  • Do not admit liability for any incident whether verbally or in writing.
  • Take all reasonable steps following an incident to protect the person or property from further injury or damage.
  • Should any third party or their insurer/solicitor contact you, please avoid entering into any conversation with them regarding the alleged incident and refer them to eSentry/Tokio Marine.
  • Obtain as much information as possible for example witness details, contact details of all parties involved..

Tokio Marine will determine if a loss adjustor or solicitor is to be appointed, therefore please retain any relevant items/documentation and confirm specifics of location/site where incident occurred.
